This means that Texas law generally assumes both parents play an important role, with right and duties assigned to each, as long as it is in the best interest of the child.
While the law makes the presumption that joint managing conservatorship is best, individuals can argue against it when they believe that something else is in their children's best interests. Additionally, while the court uses joint managing conservatorship as a general rule, there are times when it is inappropriate. If one of the parents has engaged in domestic violence, then it is unacceptable to have joint managing conservatorship over the child.
